Don't panic, but act fast! The sooner you report the scam, the better your chances of recovering funds.
Contact your bank, credit card company, or payment service provider (PSP) immediately by calling their customer care number or visiting a branch in person and obtain complaint reference number.
Temporarily block or suspend your bank account, credit card, debit card, or PSP (payment service provider) account
If you've lost money from your account due to unauthorized transactions, report it within 0-3 days to increase your chances of recovery.
2. File a Cyber Crime Report:
Visit your local police station or file a report online at the Cyber Crime Reporting Portal.
Provide all the details of the scam, including any evidence you have.
3. Gather evidence:
Collect any transaction records, emails, chats or communication related to the scam along with complaint reference number obtained from banks and PSP and Copy of report filed to Cyber cell.
4. File Written Request for Refund to Bank:
File a formal request to your bank in writing to claim refund of stolen funds by explaining the situation, narrating the transactions and submitting evidences. Your bank will then investigate and may be able to reverse the transaction if reported promptly.
5. File Written Complaint with NPCI:
File Complaint with National Payments Corporation of India (NPCI), if your PSP (payment service provider) doesn't resolve the issue satisfactorily.
Provide all the details of the scam, including any evidence you have.
6. Escalate Your Complaint:
If your bank or PSP fails to resolve your complaint within 30 days, you have the right to escalate it to the Banking Ombudsman. This independent authority can help you reach a fair resolution.
7. Appeal to the Appellate Authority:
The Reserve Bank of India (RBI) has an Appellate Authority specifically for appeals against the Banking Ombudsman's decisions.
You can file an appeal within 30 days from the date of Banking Ombudsman's decisions.
Be sure to clearly state your grounds for appeal and provide any new evidence or arguments.
8. Explore other Legal Options:
If the appeal to the Appellate Authority is unsuccessful, you may consider taking legal action against the bank.
Consult with a lawyer to understand your rights and the best course of action.
9. Check for Insurance and Compensation:
Many banks and credit card companies offer compensation for unauthorized transactions.
